Terms and Conditions

1. General

1.1 These Terms and Conditions apply to all lotteries and sweepstakes promoted by Racehorse Relief (Registered Charity No. 1157554) under the Small Society Lottery registration granted by Cornwall Council.

1.2 By purchasing a ticket or entering a sweepstake, the entrant agrees to be bound by these Terms and Conditions.

1.3 The lottery is promoted by Racehorse Relief, Vicarage Farm, Underlane, Helston, TR13 0EJ.

1.4 The designated promoter for these lotteries is Paul Massey, acting in their capacity as a Trustee of the Society.

2. Eligibility

2.1 Entry is open only to residents of Great Britain (England, Scotland, and Wales).

2.2 Tickets may not be sold to, or by, any person under the age of 18 years.

2.3 If a ticket is sold unknowingly to, or on behalf of, a person under the age of 18, they will be exempt from the lottery and forfeit their entry fee and any potential prize.

2.4 Racehorse Relief reserves the right to ask for proof of age of any entrant.

3. Entry and Tickets

3.1 Entry into the lottery (e.g., "The Charity Flutter") requires the purchase of a virtual ticket.

3.2 The price of each ticket is £5.00. The price of tickets for each draw will be the same for all entrants.

3.3 Tickets are non-transferable and non-refundable.

3.4 Tickets will be issued virtually via email or app notification immediately upon purchase.

3.5 In accordance with the Gambling Act 2005, the virtual ticket confirmation will state:

  • The name of the promoting society: Racehorse Relief.
  • The price of the ticket.
  • The name and address of the designated promoter.
  • The date of the draw (or the race event being used to determine the winner).

3.6 Purchase Limits: To support responsible gambling and ensure fair access to the lottery, the Society limits the number of tickets that may be purchased by any single individual to 20 tickets per draw. Any attempt to purchase tickets in excess of this limit will be blocked.

4. Game Mechanics & Non-Runners

4.1 Allocation: Horses are assigned to tickets using a random, balanced distribution algorithm.

4.2 Timing of Allocation:

  • Pre-Event Sales: Tickets purchased prior to the final declaration stage (usually 48 hours before the race) will hold a "Pending" status. These tickets will be randomly assigned a horse once the final field of runners is confirmed.
  • Live Sales: Tickets purchased after the final declarations will be assigned a horse immediately upon purchase.

4.3 Non-Runners (Withdrawn Horses):

  • If a horse is withdrawn from the race before the allocation stage, it will not be included in the draw.
  • If a horse is withdrawn after it has been assigned to a ticket (e.g., a "Non-Runner" declared on race day), the ticket is deemed a losing entry.
  • Charity Donation Clause: In the event of a Non-Runner/withdrawal, the entry fee will not be refunded. It will be treated as a direct donation to Racehorse Relief to support the charity's work.

4.4 The Society's decision on the allocation of horses and determination of winners is final.

5. Prizes and Proceeds

5.1 A minimum of 20% of the total proceeds of each lottery will be applied directly to the charitable purposes of Racehorse Relief (rehabilitation, retraining, and rehoming of ex-racehorses).

5.2 The remaining proceeds will be allocated to the Prize Pot and administrative costs.

5.3 The Prize Pot will be shared equally among all entrants holding a ticket for the winning horse (and placed horses, where applicable).

5.4 The total value of tickets put on sale for any single lottery shall not exceed £20,000.

5.5 The total value of tickets put on sale for all lotteries in a calendar year shall not exceed £250,000.

5.6 The maximum value of any single prize will not exceed £25,000.

5.7 Winners will be notified via email within 7 days of the draw. Prizes will be paid via bank transfer or refunded to the payment card used for entry.

5.8 Unallocated Prizes: In the event that a winning, second, or third-placed horse has no corresponding ticket holder (e.g., due to total ticket sales being lower than the number of runners), the prize money allocated to that specific position will not be distributed to other prize winners. Instead, it will be retained by the Society and applied directly to the charitable purposes of Racehorse Relief.

5.9 Claim Period: Winners must claim their prize within 6 months of the draw date. Racehorse Relief will make reasonable attempts to contact the winner via the email address provided at the time of entry. If a prize remains unclaimed after the 6-month period, the winner forfeits their right to the prize, and the funds will be treated as a general donation to the Society.

5.10 Payment Details: It is the sole responsibility of the entrant to provide accurate bank account details for the payment of prizes. Racehorse Relief accepts no liability for payments made to an incorrect account due to errors in the data provided by the entrant. If a payment is lost due to incorrect details provided by the winner, the prize will not be reissued.

6. Responsible Gambling

6.1 Racehorse Relief is committed to responsible gambling.

6.2 The Society encourages all entrants to gamble responsibly. If you have a problem with gambling, please visit www.begambleaware.org.

6.3 A self-exclusion policy is in place. Any individual wishing to self-exclude from future lotteries may do so by contacting the Society at [email protected].

7. Liability

7.1 Racehorse Relief accepts no liability for any loss, theft, or delay in the delivery of virtual tickets or payments caused by technical failures or events beyond its control.

7.2 Racehorse Relief accepts no liability for the cancellation of any sporting event upon which the sweepstake relies. In such an event, the Society reserves the right to treat the entry fees as a donation or refund them at its discretion, subject to deducting reasonable administrative costs.

8. Data Protection

8.1 Personal data collected for the purpose of the lottery will be processed in accordance with the Data Protection Act 2018 and the Society's Privacy Policy. Data will only be used for the administration of the lottery and will not be shared with third parties for marketing purposes.
